Annotation |
The article addresses the issue of Russian law development in philosophy with reference to the
systemic and especially the synergetic approach. The legal system is presented as a kind of hybrid systems.
The systemic approach necessarily leads to synergetics. The article describes the basic concepts
of the synergetic approach, “bifurcation point”, “fluctuation”, and “entropy”. The difficulty in applying
the synergistic approach to the analysis of law lies in the fact that it should follow the analysis of the
macrosystem, i.e. culture. The actual application of the synergetic approach to the law and legal culture
requires a rather specific selection of subsystems such as law (the legal culture of the country) and other
cultural subsystems, which together with the legal culture, form a system of the national culture.
